Please read these Terms of Service ("Terms") carefully before using the rxJournal mobile application or website (collectively, the "Services") operated by rxJournal ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Services, you confirm that you are at least 13 years of age and that you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

2. Description of Services

rxJournal is a fitness journaling application that provides:

  • Workout journaling and tracking tools
  • AI-powered workout of the day (WOD) generation
  • Score and performance tracking
  • Photo attachments for journal entries
  • Pro subscription features with expanded access

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with or without notice.

3. User Accounts

To use the Services, you must create an account. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

We reserve the right to terminate accounts that violate these Terms.

4. Subscriptions and Payments

Free Tier

rxJournal offers a free tier with limited access to certain features, including a limited number of AI-generated workouts per day and access to recent journal history.

Pro Subscription

rxJournal Pro is available as a monthly ($9.99/month) or annual ($79.99/year) subscription. Pro subscribers receive unlimited AI-generated workouts and full journal history access.

Billing

  • Subscriptions are billed through the Apple App Store or Google Play Store, depending on your device.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription through your App Store or Google Play account settings.
  • Refunds are subject to the policies of the applicable app store.

5. User Content

You retain ownership of any content you create within the Services, including journal entries and photos. By submitting content, you grant us a limited, non-exclusive license to store and display your content solely for the purpose of providing the Services to you.

You agree not to submit content that:

  • Violates any applicable law or regulation
  • Infringes third-party intellectual property rights
  • Contains harmful, offensive, or abusive material
  • Includes others' personal information without consent

6. Prohibited Uses

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Services
  • Interfere with or disrupt the Services or servers
  • Scrape, crawl, or otherwise extract data from the Services
  • Reverse engineer or decompile any part of the Services
  • Use the Services to transmit spam or unsolicited communications

7. Health Disclaimer

rxJournal is a fitness journaling tool and is not a substitute for professional medical advice, diagnosis, or treatment. The AI-generated workouts and content are for informational purposes only. Always consult a qualified healthcare professional before starting any new exercise program. We are not liable for any injury or health issue resulting from use of the Services.

8. Intellectual Property

The Services and all content, features, and functionality (excluding user content) are owned by rxJournal and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RXJOURNAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless rxJournal and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Services or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Texas.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms in the app or via email. Continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the Services at our sole discretion for violation of these Terms or any other reason, with or without notice. Upon termination, your right to use the Services will immediately cease.
